Intra-company Transfer (ICT) Work Permit for Employees of Multinational Entities

Organizations aiming to facilitate the movement of employees to Canada must consider the ICT work permit as a strategic avenue. This work authorization is applicable when there is a significant corporate linkage between the sending entity abroad and the receiving entity within Canada. Specifically, eligibility hinges on the established connection being that of a parent company, a subsidiary, a branch, or an affiliated enterprise.

For the ICT work permit application to be successful, it is imperative that both the foreign and Canadian business entities are actively engaged in the trade of goods or provision of services. Merely possessing a physical office space in Canada does not suffice. The Canadian entity, therefore, must have active operational activities within the country.

Employees who stand to benefit from the ICT work permit offered by PL Immigration must occupy positions that are executive, managerial, or involve specialized knowledge within the company. This mode of transfer serves to strengthen corporate ties, enhance global business strategies, and promote the exchange of expertise within multinational corporations.

Eligibility Criteria for Obtaining an Intra-Company Transfer (ICT) Work Permit

Employees seeking to relocate and work within a branch of their multinational corporation in Canada may be eligible for an ICT work permit. To qualify, applicants must meet the following:

Current Employment with a Global Firm

The applicant should be actively employed by a global enterprise and wish to enter Canada to perform work within a parent, affiliate, subsidiary, or branch of that global corporation.

Relocation to a Qualifying Company Entity

The transfer should be to a Canadian company with a qualifying relationship to the applicant’s current employer. The Canadian establishment should be legitimate and operational.

Consistent Employment History

Applicants should have been engaged in consistent full-time employment (either on the payroll or under contract) by the entity planning the transfer to Canada, fulfilling a similar role for at least one year within the three years preceding the initial application submission.

Part-time Employment Considerations

When the applicant has part-time employment history, Immigration, Refugees and Citizenship Canada (IRCC) will evaluate additional factors, including the duration employment with the foreign company, the similarity between the foreign and Canadian positions, the nature of the part-time role, and ensure the integrity of the ICT work permit program isn’t compromised.

Recent Acquisitions and Mergers

In cases of recent corporate mergers or acquisitions, the one-year employment requirement may be waived if the employee has been with any of the affiliate entities for at least a year within the last three years. The newly formed entity must continue the business of the original entity and maintain its assets, obligations, and liabilities.

Temporary Assignment

Applicants must plan to remain in Canada temporarily and adhere to all Canadian temporary entry immigration laws.
